OpenAI has challenged a foundational claim Tesla CEO Elon Musk made in the lawsuit he filed against the startup earlier this month. "There is no Founding Agreement, or any agreement at all with Musk, as the complaint itself makes clear," OpenAI said in a document on file with California's superior court for San Francisco County. "The Founding Agreement is instead a fiction Musk has conjured to lay unearned claim to the fruits of an enterprise he initially supported, then abandoned, then watched succeed without him." Musk quoted OpenAI's 2015 certificate of incorporation with the Delaware secretary of state, asserting that it "memorialized" the founding agreement. "Seeing the remarkable technological advances OpenAI has achieved, Musk now wants that success for himself," OpenAI said in its filing.

OpenAI is reinstating CEO Sam Altman to its board of directors and said it has “full confidence” in his leadership after the conclusion of an outside investigation into the company's turmoil. After months of investigation, it found that Altman's ouster was a “consequence of a breakdown in the relationship and loss of trust” between him and the prior board, OpenAI said in a summary of the findings Friday. The investigation found the prior board acted within its discretion. “The review concluded there was a significant breakdown in trust between the prior board, and Sam and Greg,” Bret Taylor, the board’s chair, told reporters Friday. After it retained the law firm in December, OpenAI said WilmerHale conducted dozens of interviews with the company’s prior board, current executives, advisers and other witnesses.

OpenAI said on Friday that Sam Altman, its high-profile chief executive, would rejoin its board of directors more than three months after he was briefly pushed out of the company. The move caps a highly anticipated report by a law firm hired by OpenAI’s board of directors to investigate Mr. Altman and his sudden removal from the company in November. “The special committee recommended and the full board expressed their full confidence in Mr. Altman and Mr. Brockman,” Mr. Taylor said, referring to Greg Brockman, the company president who quit in protest after Mr. Altman was removed. “We are excited and unanimous in our support for Sam and Greg.”The company said that the report found that OpenAI’s board acted within its broad discretion to terminate Mr. Altman, but also found that his conduct did not mandate removal. New York CNN —OpenAI fired back at Elon Musk, who sued the ChatGPT company last week for chasing profit and diverging from its original, nonprofit mission. Tuesday night, OpenAI published several of Musk’s emails from the early days of the company that appear to show Musk acknowledging OpenAI needed to make a ton of money to fund the incredible computing resources needed to power its AI ambitions. OpenAI in a blog post Tuesday night said Musk never followed through on his promise, committing $45 million in funding for OpenAI, while other donors raised $90 million. Musk, in a February 1, 2018, email, told company executives that the only path forward for OpenAI was for Tesla, his electric car company, to buy it. The company said in its blog post that it has not diverged from its mission, and it would move to dismiss all of Musk’s claims.

Three weeks after OpenAI's board briefly pushed out CEO Sam Altman without providing a specific reason for its decision, former director Reid Hoffman says he's still puzzled by what took place and why. He stepped down from OpenAI's board in March and said he hasn't spoken with any of the board members, though he said he did communicate with Altman. Microsoft CEO Satya Nadella offered to hire Altman, OpenAI president Greg Brockman and their colleagues in a new advanced AI research group.
